3)受美國食品藥品監(jiān)督管理局(FDA) 監(jiān)管的醫(yī)療器械或藥品及其包裝，包括假肢和矯形器

4)含有故意添加PFAS的冷卻、供暖、通風(fēng)、空調(diào)或制冷設(shè)備；或根據(jù)重要新替代品政策計(jì)劃（40CFR第82部分的G子部分）被列為可接受、在符合使用條件的情況下可接受或在縮小使用限制的情況下可接受的制冷劑

5)用于動(dòng)物體內(nèi)或身上的獸藥產(chǎn)品及其包裝

6)為公共衛(wèi)生、環(huán)境或水質(zhì)檢測(cè)而開發(fā)或制造的產(chǎn)品

7)美國法典U.S.C. 第49篇第30102 節(jié)(a)(10) 定義的機(jī)動(dòng)車輛或機(jī)動(dòng)車輛設(shè)備，但該豁免不適用于此類商品中所含或作為此類商品組成部分的任何紡織品或制冷劑

8)任何其他機(jī)動(dòng)車輛，包括非公路車輛或特種機(jī)動(dòng)車輛，如全地形車、并排式車輛、農(nóng)用設(shè)備或個(gè)人輔助移動(dòng)裝置

13)用于發(fā)電、配電或儲(chǔ)電的產(chǎn)品

14)直接用于制造或開發(fā)第1~13項(xiàng)所述產(chǎn)品的設(shè)備

15)環(huán)境改善委員會(huì)(EIB)已通過一項(xiàng)規(guī)則，規(guī)定在該產(chǎn)品中使用PFAS是目前不可避免使用的

16)含有氟聚合物的產(chǎn)品，該聚合物主鏈為全氟或多氟化碳主鏈，或在標(biāo)準(zhǔn)溫度和壓力下為固體的全氟聚醚主鏈

另外，在2027 年1 月1 日或之前，直接或間接或通過中間商在新墨西哥州銷售、提供銷售或分銷產(chǎn)品的制造商，如果產(chǎn)品中含有故意添加的PFAS ，須向環(huán)境保護(hù)部提交以下信息：

-產(chǎn)品簡(jiǎn)要描述，包括通用產(chǎn)品代碼（UPC）、SKU編碼或分配給產(chǎn)品的其他數(shù)字代碼

-PFAS在產(chǎn)品中的用途

-產(chǎn)品中每種PFAS 的含量

-制造商（及聯(lián)系人）的名稱、地址和電話號(hào)碼

-要求提供的任何其他信息

注：

1)“炊具”是指用于直接接觸食物并用于準(zhǔn)備、分配或儲(chǔ)存食物、食品或飲料的耐用家庭用品。

2)“青少年產(chǎn)品”是指為12歲以下兒童設(shè)計(jì)或銷售使用的產(chǎn)品，包括兒童汽車座椅、服裝和玩具。但不包括電子產(chǎn)品，具體包括：

-個(gè)人電腦和任何相關(guān)設(shè)備

-音頻和視頻設(shè)備

-計(jì)算器

-無線電話

-游戲機(jī)

-帶有視頻屏幕的手持設(shè)備，和

-任何相關(guān)的外圍設(shè)備，如鼠標(biāo)、鍵盤、電源裝置或電源線。

3)“軟墊家具”是指全部或部分填充有填充材料的家具。

On April 8, 2025, the Governor of U.S. New Mexico State signed BillHB 212 (Per- and Poly-Fluoroalkyl Substances Protection Act) toregulate PFAS in products.

The following products containing intentionally added PFAS shallnot be sold, offered for sale, distributed, or distributed for salein New Mexico by manufacture, directly or indirectly or throughintermediaries, after the relevant effective date:

But there are 16 categories of products that are exempt from aboveprohibition. These products include:

1)A product for which federal law governs the presence of a PFAS inthe product in a manner that preempts state authority

2)Used product for sale or resale

3)Medical devices or drugs and the packaging of the medical devicesor drugs that are regulated by the United States Food and DrugAdministration, including prosthetic and orthoticdevices

4)Cooling, heating, ventilation, air conditioning or refrigeratione that contains intentionally added PFAS or refrigerantslisted as acceptable, acceptable subject to use conditions oracceptable to narrowed use limits by the United Statesenvironmental protection agency pursuant to the significant newalternatives policy program, 40 Code of Federal Regulations, Part82, Subpart G and sold, offered for sale or distributed for salefor the use for which the refrigerant is listed pursuant to thatprogram

5)A veterinary products and its packaging intended for use in or onanimals

6)A product developed or manufactured for the purpose of publichealth or environmental or water testing

7)A motor vehicle or motor vehicle e regulated under afederal motor vehicle safety standard, as defined in 49 UnitedStates Code, Section 30102(a)(10), except that the exemption underthis paragraph does not apply to any textile article or refrigerantthat is included in or as a component part of suchproducts

8)Any other motor vehicle, including an off-highway vehicle or aspecialty motor vehicle, such as an all-terrain vehicle, aside-by-side vehicle, farm e or a personal assistivemobility device

9)A watercraft, an aircraft, a lighter than-air aircraft or aseaplane

10)A semiconductor, including semiconductors incorporated inelectronic e, and materials used in the manufacture ofsemiconductors

11)Non-consumer electronics and non-consumer laboratory enot ordinarily used for personal, family or householdpurpose

12)A product that contains intentionally added PFAS with uses thatare currently listed as acceptable, acceptable subject to useconditions or acceptable subject to narrowed use limits in theUnited States environmental protection agency's rules under thesignificant new alternatives policy program; provided that theproduct contains PFAS that are being used as substitutes forozone-depleting substances under the conditions specified in therules

13)A product used for the generation, distribution or storage ofelectricity

14)E directly used in the manufacture or development of theproducts described in Paragraphs (1) through (13)

15)A product for which the Environmental Improvement Board(EIB) hasadopted a rule providing that the use of the PFAS in that productis a currently unavoidable use

16)A product that contains fluoropolymers consisting of polymericsubstances for which the backbone of the polymer is either a per-or polyfluorinated carbon-only backbone or a perfluorinatedpolyether backbone that is a solid at standard temperature andpressure

In addition, on or before 1 January 2027, the manufacturers of aproduct sold, offered for sale, distributed, or distributed forsale in New Mexico, directly or indirectly or throughintermediaries, that contain an intentionally added PFAS shallsubmit to the Department of Environment the information thatinclude:

-A brief description of the product, including a universal productcode (UPC), stock keeping unit (SKU), or other numeric codeassigned to the product

-The purpose for which PFAS are used in the product

-The amount of each PFAS in the product

-The name, address, and phone number of the manufacturer (and thecontact person)

-Any additional information requested.

Note:

1)“Cook ware” means a durable houseware items intended for directfood contact and used to prepare, dispense or store food,foodstuffs or beverages.

2)“Juvenile product” means a product designed or marketed for useby children under twelve years old, including children's car seats,clothing and toys, but does not include an electronic product,including:

-Personal computers and any associated e;

-Audio and video e;

-Calculators;

-Wireless phones;

-Gaming consoles;

-Handheld devices incorporating a video screen; and

-Any associated peripheral device, such as a mouse, keyboard, powersupply unit or power cord.

3)“Upholstered furniture” means furniture that is wholly orpartially stuffed with a filling material.
